PearNet servers will not be listed in any spammed message, either as an originator, intermediary, or reply-to address. PearNet defines spam to be any mass unsolicited message in the mediums of email, newsgroups, or web hosting. The internet is not a broadcast medium. We are absolutely forbidden for spam mail usuage.

Unlimited storage and bandwidth usuage
Hi Hi Net services include "unlimited storage" and "unlimited bandwidth" in an effort to give our
customers flexibility and breathing room with the elimination of artificial space and bandwidth "ceilings."
We expect our customers to use these unlimited resources in good faith.
Large sites (100 megabytes in storage, or 2 gigabytes in bandwidth per month) MUST
make prior arrangements with PearNet before signing up.
In short, Hi Hi Net will give large sites the flexibility they need, provided that such
accounts do not negatively affect other Hi Hi Net customers.
Due to the unique resource characterstics and hit patterns associated with certain site types,
the following types of sites do not qualify for unlimited space or bandwidth,
and should contact Hi Hi Net regarding metered rate
accounts: file archives (including shareware archives, sound archives, video archives,
image archives, and multimedia archives).

Our unlimited storage policy also applies to our email accounts. However, PearNet email accounts may not be used for permanent storage of email. Email accounts must be cleared periodically. In other words, don't click the "leave mail on server" box found in many popular email clients.

Hi Hi Net prohibits the use of accounts for the purposes of hacking, network snooping, or other illegal activities. Our accounts are provided for the sole purpose of web and email hosting. Use them accordingly.
Refusal of Service
Hi Hi Net reserves the right to refuse service to anyone.

Abuse

If the customer violates Hi Hi Net policies, Hi Hi Net will terminate the account, and no refund will be paid. In instances where spam or other flagrant abuse of Hi HI Net resources is involved, the customer may be subject to "theft of service" fines, and/or other legal action.
Denial-of-service attacks (purposeful misuse of Hi Hi Net's resources for the purpose of denying service to others, regardless of whether the targeted systems are managed by PearNet) will not be tolerated, and will result in the immediate termination of the account, and possible legal action.
Billing & Cancellation Policy
At your option, accounts are billed semiannually, or annually.
Except for your initial (pro-rated) payment, payment is due at the 1st of each anniversary month.
Credit cards are charged automatically on the 1st of the month, unless we receive written
instructions indicating otherwise. Should payment not be received by the 3rd of each month, or
should your credit card not go through, you will receive an email message indicating the problem.
If the situation is not resolved within 3 days, your account is subject to suspension or termination.
Prices are guaranteed for the period of prepayment only. All funds are in U.S. currency. Returned
checks are subject to a $30 fee.
Special policy for international users: Although we prefer credit card as the payment method
for international users, Hi Hi Net accepts payment by international money
order and other international forms of U.S. currency. If you do not expect initial payment to arrive
within 7 days, please fax us a receipt indicating: 1) that payment has been mailed, or 2) that the payment
process has been initiated, along with an approximate ETA for your payment.
Hi Hi Net reserves the right to cancel service at any time for any reason. Should Hi HI Net cancel your service, your annuauly and setup fees will be prorated and non-refundable. In either case, InterNIC fees are not refundable.
Disclaimer
Under no circumstances shall Hi Hi Net be liable for any direct, indirect, special, incidental, consequential, or punitive damages that result in any way from your or your clients' use, misuse, or inability to use Hi Hi Net services or any part thereof, or for those damages that result from mistakes, omissions, interruptions, deletion of files, errors, defects, delays in operation, or transmission, or any failure of performance on the part of Hi Hi Net.
To the maximum extent permitted by applicable law, Hi Hi Net will not be held liable for any damages, including, but not limited to, loss of profits, business interruption, damage to person or business, loss of business, or any other damage or loss.
Hi Hi Net provides services "as is" without warranty, expressed or implied, including, but not limited to, merchantability or fitness for a particular purpose. This disclaimer of warranty and liability constitutes an essential part of this agreement.
Some states do not allow the exclusion or limitation of liability for certain damages. Hi Hi Net's entire liability and your exclusive remedy shall not exceed the price you paid for Hi Hi Net services.
Hi Hi Net reserves the right to change its policies at any time, for any reason.
